HireUp connects candidates, employers, and recruiters. We are not an employment agency and do not make hiring decisions.
Professionalism Required
You must provide accurate information, respect other users, and use the platform honestly.
AI Assists, Humans Decide
We use AI to help parse CVs and draft job descriptions, but humans make all actual hiring decisions.
Your Role Matters
Depending on whether you are a Candidate, Employer, or Recruiter, you will have additional specific agreements to review and accept.

Introduction
We explain what HireUp is and what you agree to by using our platform.
Welcome to HireUp! These Platform Terms of Service ("Terms") are a legally binding contract between you and HireUp AI (Pty) Ltd ("HireUp," "we," "us," or "our").
HireUp operates a recruitment marketplace. This means we provide a platform connecting Candidates, Employers, and Recruiters. We act as an intermediary coordinating the recruitment process. HireUp is not an employer, a staffing firm, or an employment agency. We do not guarantee employment outcomes, and we are not a party to any employment contracts formed between Candidates and Employers.
By registering for an account or using our platform, you agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy.
Who Can Use HireUp
You must be of legal working age and authorised to form a binding contract to use our services.
To use the HireUp platform, you must:
- Be of legal working age in your jurisdiction (and in any event at least 16 years old).
- Have the legal right and capacity to enter into a binding contract.
- Not be restricted from using our platform under applicable laws or by our prior action (e.g., a previous account suspension).
What You Agree To Do
You promise to be truthful, professional, and keep your account details secure.
To maintain a high-quality marketplace, you agree to:
- Provide accurate information: Ensure your profile, CVs, job postings, and all other information you provide are truthful, complete, and kept up-to-date.
- Act professionally: Treat all other platform users with respect and communicate professionally.
- Protect your account: Keep your login credentials secure. You are responsible for all activity that occurs under your account.
What You Must Not Do
You agree not to misuse the platform, provide fake information, or try to bypass our marketplace systems.
You agree that you will not:
- Create fake profiles, misrepresent your identity, or impersonate anyone else.
- Attempt to bypass, circumvent, or manipulate the marketplace to directly contact other users outside of the platform.
- Use bots, scrapers, spiders, or other automated systems to extract data from HireUp.
- Upload harmful code, viruses, or do anything that could disable, overburden, or impair the proper working of the platform.
- Post content that is discriminatory, offensive, defamatory, illegal, or infringes on another party's intellectual property rights.
Your Content
You own your data, but you give us permission to use it to run the platform.
When you upload content to HireUp (such as your CV, profile details, or job descriptions), you retain ownership of it. However, you grant HireUp a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content to operate and provide the platform.
We will only share your content according to your role, our Privacy Policy, and the design of our marketplace. We reserve the right to remove any content that violates these Terms.
AI-Powered Features
We explain how our AI tools work and clarify that they never make hiring decisions for you.
HireUp integrates artificial intelligence (AI) to improve your experience. Currently, our AI features include:
- CV Parsing: Extracting structured data from uploaded CVs to build profiles.
- Professional Summaries: Drafting suggested professional summaries based on candidate data.
- Job Description Assist: Helping employers parse and structure job requirements.
- Candidate Scoring: Generating fit scores that help employers prioritise which candidates to review. Scores are a decision-support tool — they do not rank, filter, or reject candidates automatically.
AI is assistive only. HireUp's AI does not make automated hiring, shortlisting, or rejection decisions. All hiring decisions are made entirely by the Employer. You can read more about how AI processes data in our Privacy Policy.
Role-Specific Agreements
You may need to agree to extra terms based on how you use the platform (e.g., as an employer or candidate).
Because HireUp connects three distinct types of users, your use of the platform is also governed by an additional agreement specific to your role. You will be asked to review and accept the relevant agreement during onboarding:
- Candidates: Are subject to the Candidate Agreement.
- Employers: Are subject to the Employer Terms of Service and Data Processing Agreement.
- Recruiters: Are subject to the Recruiter Agreement.
If there is a conflict between these general Platform Terms and your role-specific agreement, the role-specific agreement will take precedence.
Intellectual Property
We own the HireUp platform, our brand, and our underlying technology.
While you own your personal content, HireUp retains all ownership, rights, and interest in the platform itself. This includes our website, applications, underlying code, AI models, design, trademarks, logos, and all other intellectual property associated with HireUp.
You may not copy, modify, or distribute any part of our intellectual property without our prior written consent.
Third-Party Services
We use external services to keep the platform running, but we aren't responsible for third-party websites.
Our platform relies on third-party integrations (such as hosting providers and AI model providers) to function. We may also provide links to third-party websites. HireUp is not responsible for the availability, security, or content of these external services. Your use of third-party links is at your own risk.
Disclaimers
We provide the platform "as is" and cannot guarantee you will get a job or find the perfect hire.
We provide the HireUp platform on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied.
- We do not guarantee that the platform will always be error-free, secure, or uninterrupted.
- We do not guarantee the accuracy of any user-generated content, including Candidate qualifications or Employer job descriptions.
- We do not guarantee any specific recruitment outcomes, such as a Candidate securing a job or an Employer finding a suitable hire.
Limitation of Liability
We limit our legal and financial liability if something goes wrong while using the platform.
To the fullest extent permitted by law, HireUp (including its directors, employees, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data, goodwill, or missed employment opportunities arising out of your use of the platform.
In no event shall our total aggregate liability for all claims related to these Terms exceed the amount you have paid us in the past twelve (12) months, or $100 USD, whichever is greater.
Indemnification
If your actions on the platform get us sued, you agree to cover those costs.
You agree to indemnify, defend, and hold harmless HireUp and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your violation of any law or the rights of a third party.
- Any content you submit to the platform.
Account Suspension & Termination
We can suspend or close your account if you break these rules.
You may close your account at any time through your settings. HireUp reserves the right to suspend or terminate your account immediately, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the platform.
Upon termination, your right to use the platform will immediately cease. For information on how we handle your data upon account closure, please refer to our Privacy Policy.
Changes to These Terms
We can update these terms, and we'll let you know when we do.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by placing a prominent notice on the platform at least 30 days before the changes take effect.
By continuing to use the platform after the new terms become effective, you agree to be bound by the updated Terms.
General
Standard legal housekeeping (e.g., if one clause is invalid, the rest still apply).
- Entire Agreement: These Terms, along with our Privacy Policy and your role-specific agreement, constitute the entire agreement between you and HireUp.
- Severability: If any part of these Terms is found to be unenforceable by a court, the remaining parts will still apply.
- Assignment: You may not transfer or assign these Terms to anyone else without our written permission. We may assign these Terms to a corporate affiliate or in the event of a merger or sale.
Governing Law & Disputes
Disputes are handled under South African law via arbitration, though your local consumer rights are protected.
These Terms shall be governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
- Informal Resolution: If you have a dispute with us, you agree to contact us first to attempt an informal resolution over a 30-day period.
- Arbitration: If the dispute cannot be resolved informally, it shall be finally resolved by binding arbitration administered by the Arbitration Foundation of Southern Africa (AFSA) in Johannesburg, South Africa.
- Consumer Protection: Notwithstanding the above, if you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms deprives you of the protection afforded to you by those mandatory local laws. You may still have the right to bring proceedings in your local courts.
